If we think of “cybercrime” as a virus, then it can be said that this virus is destroying the major developments of mankind (computers and the Internet), which are responsible for the civilized society of mankind. Cybercrime is a worldwide threat and one of the most difficult crimes to detect and investigate. “Russia, China and Brazil lead the world in cybercrime. India is fast becoming a major hub for cybercrime, but our legal system is in place to deal with the threat of cybercrime and to control and punish it. Major cities have established cybercrime teams by law. These groups report directly to the police chiefs of the respective cities. Since 1999, the Central Bureau of Investigation (CBI) has had a cybercrime unit.

The Government established the Network Regulations Appellate Tribunal under the Information Technology Act 2000. The court has the same powers as a civil court and can order the discovery and production of documents and receive affidavits of evidence. But the High Court can challenge the tribunal’s decision. The Information Technology Act not only applies to crimes committed in India, but can also be used to bring criminals from foreign countries to India for trial.

Powers of the Cybercrime Team:

Any police officer not below the rank of deputy superintendent, or any other officer of the Central Government or a State Government authorized by the Central Government for that purpose, may enter any public place to search and arrest, without a warrant, any person found therein. A person is reasonably suspected of having committed or is committing or is about to commit any offense under this Act.

Punishment for cybercrime:

Those found guilty of cybercrime will be punished with up to three years in prison or a fine, or both.

Salient features of the Information Technology (Amendment) Act 2008:

The Information Technology (Amendment) Act 2008 was enacted in October 2009.

The term “digital signature” has been replaced with “electronic signature”, making the bill more technology-neutral. A new section has been inserted to define that “communication device” means a cell phone, personal digital assistant or a combination of both or any other device used to communicate, send or transmit any text video, audio or image. Added a new section defining “Internet cafe” as any facility where any person provides Internet access to members of the public in the ordinary course of business.

Several new offenses were added to the Act. Section 66 has now been expanded to include Sections 66A (Offensive Information), 66B (Receiving Stolen Computers), 66C (Identity Theft), 66D (Impersonation), 66E (Voyeurism), and 66F (Cyberterrorism).
