Getting Into Canada After a DUI Conviction
There was a period a few years ago when US citizens were allowed into Canada without any sort of intrusion or hardship by Border Patrol agents. Unfortunately, a lot has changed at the border since September 11th, and the days of Border Patrol agents wandering into Canada in the blink of an eye are long gone.
As a DUI attorney, I work with many people facing DUI charges, and sometimes with people who have already been convicted. It is important to understand how to avoid some of the side effects, such as denial of entry to Canada when a resolution is reached on a DUI issue. That alone would be an entire article and beyond the scope of this article. What I want to talk about is what happens when a person is convicted of DUI and how they then get permission to enter Canada.
So let’s talk about what happens if your DUI conviction is less than 5 years old. If you have a recent DUI conviction and you wish to enter Canada as a U.S. citizen, your options are very limited. You can try your luck at the border or risk being turned away. Alternatively you can apply for a temporary residence permit. The cost is approximately $200, please be aware that this process can take several months and require a lot of paperwork to fill out.
If your DUI conviction is more than 5 years old, your options are better. As always, you can try your luck at the border and risk being turned away. You can apply for a temporary residence permit as described above. Or you can apply for rehabilitation approval. Non-refundable fees range from $200 to $1,000, depending on the type of crime and the severity of the crime. In order to be approved, all you need to provide is a police certificate with a criminal record for each state in which you have lived since the age of 18. You will also need to provide the dates of each home and work address since you turned 18. Again the process like a temporary residence permit can take several months, with an average time of more than 1 year.
It’s been over 10 years now to get your DUI conviction. Since so much time had passed, the Canadian Consulate decided to accommodate these individuals. As long as you fill out the application form correctly, you can actually get to the border and apply for rehabilitation approval on the spot. If approved, your past DUIs will no longer be an issue and you can come and go as you please and experience all that Canada has to offer.
This is a tricky area of law that can be very confusing and often misunderstood. It is best to speak with an experienced DUI attorney practicing in your state
