What is adoption?

“Adoption is the act of legally placing a child with a parent or parents other than those to whom they were born. An adoption order has the effect of severing parental responsibilities and rights from the original parent(s) and transferring those responsibilities and rights to the adopted parent(s).”

How to apply for adoption of a Thai child?

A foreigner who has a home outside Thailand can submit the application through an authorized agency or the Competent Authority to DSDW or the non-governmental child protection agencies.

A foreigner who has a domicile within Thailand and proof of residence and house registration can submit the application where the residence is. The person who has a home in Bangkok can submit the application at Child Adoption Center. The person who has a home outside of Bangkok can submit the application at the Department of Social Development and Welfare of each province.

A foreigner who has a temporary domicile in Thailand and a work permit from the Labor Department of the Ministry of Labor and has lived in Thailand for at least 6 months before submitting the application can submit the application with the required document, which is certified by an embassy or consulate in Thailand.

Procedure in Thailand:

1. When all the required documents are received, they will be submitted to the Child Adoption Board which will review each qualification of adoptive parents.

2. The authority will submit the evaluation to the Board and inform the applicants through a Competent Authority whether or not they are approved as prospective adoptive parents.

3. In the event that the adoption application is processed through the Authorized Agencies, DSDW has the right to review and investigate the background of the child to be adopted to confirm that the child is legally available for Intercountry adoption.

4. In the event that the prospective parents accept the child, the case will be further submitted to the Child Adoption Board and the General Director of the DSDW for approval of pre-adoption placement either in Thailand or on board. If the prospective adoptive parents live on board, the case will then be submitted to the Minister of the Ministry of Social Development and Human Security for permission to take the child from Thailand.

5. When the pre-adoption placement is approved, an appointment is made by DSDW for the prospective parents to be interviewed by the Child Adoption Board and issue a document for the child’s travel. The prospective parents will have at least 6 months for the child’s probation.

6. After six months of probation, 3 home study reports are satisfied. The authority will submit a summary report to the Child Adoption Board for approval.

7. DSDW will notify the Ministry of Foreign Affairs about the matter. The prospective parents can register their adoption at a Thai embassy or Thai consulate. If the prospective parent lives in Thailand, they can register an adoption at a district office.

Ministry of Foreign Affairs will send a batch of adoption application to DSDW to confirm that this case is closed.
